This is a personal injury case in which the sole issue before this court is whether the plaintiff, Casimiro Benavides, should be allowed to recover prejudgment interest under Cavnar v. Quality Control Parking, Inc., 696 S.W.2d 549 (Tex. 1985). After a jury verdict was returned in his favor, Benavides requested leave to file an amended petition seeking prejudgment interest. The trial court disallowed his trial amendment, rendered judgment denying prejudgment interest, and further ordered a remittitur of the damages awarded by the jury. The court of appeals reversed the trial courts order of remittitur and affirmed the denial of prejudgment interest. 716 S.W.2d at 589. We reverse that part of the judgment denying recovery of prejudgment interest.
